These Terms of Use ("Terms") govern your access to and use of the website operated by Native Antarcticans Foundation, Inc. ("Native Antarcticans", "we", "us") at nativeantarcticans.org and related online services. By using the site, you agree to these Terms. If you do not agree, do not use the site.

About us and the site

Native Antarcticans is a nonprofit foundation (NYS 501(c)(3), EIN 93-2920501). The site provides information about our mission, educational and cultural content, membership information, campaigns, donation options, volunteer opportunities, teaching resource requests, meeting registration, and a newsletter.

Some features require an account. Administrative tools are restricted to authorized foundation users.

Eligibility and accounts

You must provide accurate information when registering. You are responsible for keeping your password confidential and for activity under your account.

We may suspend or terminate accounts that violate these Terms, misuse the service, or pose a security risk.

You may update your profile and delete your account where those options are available in account settings.

Acceptable use

You agree not to:

  • Use the site for unlawful purposes or to harass, defame, or harm others.
  • Attempt to gain unauthorized access to systems, accounts, or data.
  • Upload malware, scrape the site in a way that impairs service, or interfere with normal operation.
  • Misrepresent your identity or affiliation with the foundation.

Site content and intellectual property

Text, images, videos, audio, translations, and other materials on the site are owned by or licensed to the foundation unless otherwise stated. You may view and share links to public pages for personal, non-commercial, educational purposes consistent with our mission.

You may not copy, modify, distribute, or create derivative works from site content for commercial use without our prior written permission, except as allowed by law (for example fair use).

User-uploaded content (such as profile photos or volunteer CVs) remains yours; you grant us a limited license to store, display, and process it solely to operate the services you use.

Donations and campaigns

Donations are processed by a third-party donation platform. When you donate, you leave our site and are subject to that provider’s terms and privacy policy. We do not store your payment card details.

Displayed donation amounts, plans, and campaign descriptions are for informational purposes. Tax deductibility of contributions depends on your circumstances and applicable law; consult a tax professional. When you are signed in, we may associate your donation with your account for internal record-keeping only.

Recurring or one-time gifts are governed by the options you select on the donation partner’s form. The foundation is not responsible for that partner’s availability, errors, or payment processing.

Forms, applications, and communications

Volunteer applications, teaching resource requests, meeting sign-ups, and newsletter subscriptions are subject to review. Submission does not guarantee acceptance, approval, or a response within a specific time.

By subscribing to the newsletter you consent to receive emails from us until you unsubscribe.

Contact via email or WhatsApp is at your discretion; standard messaging rates may apply for WhatsApp.

Third-party services and links

The site links to or embeds content from third parties (for example donation platforms, social networks, press outlets, and video platforms). We do not control and are not responsible for third-party content or practices.

We rely on external providers for hosting, secure sign-in, file storage, and related online services, each subject to their own terms where applicable.

Disclaimer

The site and content are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose.

Educational materials are for general information and do not constitute professional, legal, medical, or tax advice.

Limitation of liability

To the fullest extent permitted by law, the foundation and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the site or third-party services linked from it.

Our total liability for any claim relating to the site shall not exceed one hundred U.S. dollars (USD $100) or the amount you paid us directly through the site in the twelve months before the claim, whichever is greater, except where liability cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold harmless the foundation from claims arising out of your violation of these Terms or misuse of the site, except to the extent caused by our gross negligence or willful misconduct.

Governing law

These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules. Courts in New York shall have exclusive jurisdiction for disputes, except that either party may seek injunctive relief in any competent court.

If you access the site from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

Changes

We may modify these Terms at any time. The updated date at the top will change. Continued use after changes constitutes acceptance.
